Terms of Service.
Last updated: 24 October 2026. The agreement between you and DMGL Promotions Inc. when you request a quote, place an order, or use this website.
1. Acceptance
By using dmglpromotionsinc.com (the "site") operated by DMGL Promotions Inc. ("we", "us", "our"), or by requesting a quote or placing an order, you agree to these terms. If you do not agree, do not use the site or place orders.
2. Products and services
We supply American-made industrial equipment, facility products, safety gear, and custom-branded supply to government, manufacturing, healthcare, educational, public-safety, and transit buyers. The full product catalog and specifications are available on the products page and in the SKU documentation provided with each quote.
3. American-made sourcing
Every product we sell is manufactured in the United States. We do not offer imported substitutes. Each shipment includes a US country-of-origin certificate for every line item, and where applicable, Berry Amendment textile certification and Buy American Act compliance documentation. These certifications are provided so your procurement office can document domestic sourcing without a follow-up request.
4. Quotes and pricing
All orders are quoted in writing before fulfillment. Quotes include line-item pricing, lead times, and the compliance documentation applicable to the order. Quotes are valid for 30 calendar days from the date on the quote unless otherwise stated. Verbal pricing is not binding.
5. Orders and acceptance
An order is accepted when we issue a written order confirmation in response to your purchase order, contract, or credit card payment. We may decline an order if the product is not available, if the delivery destination is outside our service area, or if the order would violate applicable law.
6. Payment terms
Payment terms are stated on your quote or invoice. For government and institutional orders, Net 30 terms are available on approved accounts. For all other orders, payment is due on receipt unless otherwise agreed in writing. Late payments may accrue a late fee of 1.5% per month (18% APR).
7. Delivery
Delivery schedules are confirmed in writing before the first item ships. If we miss a committed delivery date for a reason within our control, we cover the freight cost. Delivery risk transfers to you upon receipt at the delivery address, unless otherwise agreed in writing.
8. Returns and warranty
If a product arrives damaged or does not match the written specification, contact us within 14 days of receipt and we will arrange replacement or refund at our discretion. Consumable products and custom-branded items are generally non-returnable once used or customized, unless defective.
9. Compliance and buyer responsibilities
You are responsible for ensuring that the products you order comply with any additional requirements of your agency, facility, or contract vehicle that are not covered by our standard certification. If you require additional certifications, set-aside documentation, or contract-specific compliance, request them in writing before the order is confirmed.
10. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of an order is limited to the amount you paid us for that order. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost business.
11. Indemnification
You agree to indemnify and hold us harmless from any third-party claim arising out of your breach of these terms or your misuse of the products we supply.
12. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or our products shall be brought in the state or federal courts located in New Castle County, Delaware, and you consent to the exclusive jurisdiction of those courts.
13. Changes to these terms
We may update these terms from time to time. The "last updated" date at the top will change. Material changes will be announced on the home page. Continued use of the site or placement of orders after a change constitutes acceptance of the revised terms.
